Terms and Conditions
1. Acceptance of Terms
By accessing or using the Eatbids website or mobile application (the "Platform"), you agree to be bound by these terms and conditions (the "Terms"). If you do not agree to all of the Terms, you may not access or use the Platform.
2. Eligibility
To use the Platform, you must be at least 18 years of age and have the capacity to enter into a binding contract. You must also be a resident of the United States.
3. Services
Eatbids provides a platform for customers to request quotes and place orders for catering and event services from restaurants. Eatbids does not provide catering or event services itself and do not have any affiliate with any restaurants. All restaurants will be treated the same through the application.
4. Use of the Platform
You may use the Platform to request quotes and place orders for catering and event services from restaurants. You agree to use the Platform in accordance with these Terms and all applicable laws and regulations.
5. Fees
Eatbids does not charge any fees to customers for using the Platform. However, restaurants may charge fees for their catering and event services.
6. Order Acceptance
Restaurants are not obligated to accept any orders placed through the Platform. Restaurants may reject orders for any reason, including but not limited to:
- Availability conflicts
- Pricing conflicts
- Menu conflicts
- Other reasons at the restaurant's discretion
7. Refunds
If a restaurant cancels an order, Eatbids will work with you to obtain a refund from the restaurant. However, Eatbids cannot guarantee that you will receive a refund.
8. Disclaimer of Warranties
EATBIDS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EATBIDS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATBIDS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
11. Entire Agreement
These Terms constitute the entire agreement between you and Eatbids with respect to the Platform and supersede all prior or contemporaneous communications and agreements, whether oral or written.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.
13. Waiver
No waiver of any provision of these Terms shall be effective unless in writing and signed by both parties.
14. Notices
All notices and other communications under these Terms shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

15. Headings
The headings in these Terms are for convenience only and shall not affect their interpretation.
16. Counterparts
These Terms may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
17. Changes to Terms
Eatbids reserves the right to change these Terms at any time by posting revised Terms on the Platform. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of such changes.
